1. Acceptance of Terms

By accessing, browsing, registering for, or using PropList (accessible at listmyprop.in and related subdomains), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use or access the platform.

2. Eligibility & Account Registration

PropList is intended for real estate brokers, agents, consultants, and advisory agencies operating in India. By registering an account, you represent and warrant that:

• You are at least 18 years of age and legally competent to enter into a binding contract under applicable Indian law.
• You are an active real estate professional authorized to market properties in your respective jurisdictions.
• All information provided during registration (including full name, phone number, email address, agency name, and RERA registration) is true, accurate, and current.
• You are responsible for maintaining the confidentiality of your account credentials and password.

3. Broker Responsibilities & Listing Accuracy

You are solely and strictly responsible for the accuracy, truthfulness, and legality of all property listings, descriptions, pricing, specifications, and availability dates posted under your account. You agree that:

• You have obtained all required authorizations and mandates from property owners or developers before listing their property.
• You will not misrepresent property specifications, ownership, amenities, or legal approvals.
• You will promptly update property status (e.g. mark as Booked, Sold, Rented, or Unavailable) when a transaction concludes.
• You will adhere to all applicable central, state, and local real estate laws, including the Real Estate (Regulation and Development) Act, 2016 (RERA).

4. Uploaded Content & Intellectual Property

Brokers retain all ownership and copyright in the property photographs, floor plans, videos, and descriptions they upload to PropList.

By uploading content, you grant PropList a non-exclusive, worldwide, royalty-free license to host, display, resize, cache, and format your listings for the sole purpose of operating your digital portfolio and public property pages. You warrant that your uploaded media does not infringe the copyright, trademark, or privacy rights of any third party.

5. Prohibited Misuse & Conduct

You agree not to engage in any of the following prohibited activities:

• Posting fictitious, duplicate, bait-and-switch, or fraudulent listings.
• Impersonating another broker, agency, or individual.
• Attempting to probe, scan, or reverse-engineer PropList platform infrastructure or APIs.
• Using automated scraping, bots, or unauthorized extraction tools on platform data.
• Uploading malicious software, viruses, or corrupt files.

6. Verified Broker Badge & Scope of Verification

The Verified Broker badge indicates that PropList administration has performed a review of the broker's profile registration information and credentials.

Verification does not constitute a legal guarantee, title certification, financial endorsement, or property appraisal by PropList. PropList does not inspect physical real estate properties or guarantee the outcome of any real estate transaction. PropList reserves the right to grant, withhold, or revoke verified status at its discretion.

7. Direct Inquiries & Interactions with Inquirers

PropList is a software showcase platform that facilitates direct communication between brokers and prospective property buyers or tenants. PropList is not a real estate broker, party to negotiations, or escrow agent. Any agreements, site visits, deposits, or transactions entered into between brokers and prospective buyers are strictly between those parties.

8. Platform Availability & Modifications

We strive for continuous platform reliability, but PropList does not guarantee uninterrupted, bug-free, or error-free availability. PropList reserves the right to modify, upgrade, suspend, or discontinue platform features with or without notice.

9. Limitation of Liability & Disclaimers

To the maximum extent permitted by applicable Indian law, PropList and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities arising from your use of or inability to use the platform.

10. Account Suspension & Termination

PropList reserves the right to suspend or terminate any broker account that violates these Terms, posts fraudulent listings, or abuses the platform. You may discontinue using PropList or request account deletion at any time by contacting support.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
